DOES Training Newsletter Subscriber Agreement

  1. Terms Representation. All references to DoesTraining.com includes PRIME Education, Inc. as the owner of the newsletters intellectual property, and collectively constitute the Publisher ("Publisher").
  2. Subscription. Subject to the terms and conditions of this agreement ("Subscriber Agreement"), DOESTraining.com hereby grants access to the selected newsletters to each subscribing individual or company ("Subscriber") subject to the payment of the stated subscription fees ("Subscription Fees").
  3. Changes to Subscriber Agreement.DOESTraining.com may change the terms of this Subscriber Agreement at any time by notifying you of the change either electronically or in writing. The changes also will appear in this document, which you can access at any time by selecting the hyperlink "Terms & Conditions" on the DOESTraining.com website.
  4. Fees and Payments. You agree to pay the Subscription Fees in connection with your username and password at the rates in effect when the charges were incurred. DOESTraining.com will debit all charges to your credit/debit card submitted with the application. Subscription Fees will be debited at the beginning of your subscription or any renewal. DOESTraining.com may change the fees and charges then in effect, or add new fees or charges, by giving you notice in advance.
  5. Limited Use. Only one individual may access the newsletter selection at the same time using the same username and password. This Subscriber Agreement prohibits the Subscriber from solicitation or encouragement of internet sites or on-line services to frame, or hypertext link directly to, the newsletter(s).
  6. Ownership. Subscriber acknowledges title, ownership and all intellectual property rights are owned by DOESTraining.com and PRIME Education, Inc. ThisSubscriber Agreement does not constitute a sale of the newsletter(s), but a right to use the newsletter(s) in accordance with the terms of this Subscriber Agreement. Subscriber may not sell, assign, transfer, rent, lease or sub-license the newsletter to any third party. Subscriber may not modify, redistribute, re-write or create original content from the newsletter(s) in any manner whatsoever.
  7. Links to Third Party Sites. DOESTraining.com may contain links to Internet sites operated by parties other than DOESTraining.com. Such links are provided for your convenience only. DOESTraining.com does not control such Internet sites, and is not responsible for their contents. DOESTraining.com's inclusion of links to such Internet sites does not imply any endorsement of the material on such Internet sites or any association with their operators.
  8. Support Service. DOESTraining.com maintains a support staff which can be contacted during working hours, Monday to Friday, 8:00AM to 6:00PM (EST) except during nationally recognized holidays. You will have access to the support team by telephoning (954) 718-6055 or by email at support@doestraining.com.
  9. Termination. Subscribers may terminate this Subscriber Agreement at any time by emailing DOESTraining.com with details of each Subscribers username and password. Subscription Fees will not be refunded for early termination of the Subscriber Agreement for whatever reason.
  10. Warranty. The newsletter(s) provided under this Subscriber Agreement is provided "as is". DOESTraining.com offers no warranties, conditions, guarantees or representations as to merchantability, fitness for a particular purpose or any other warranties, whether express or implied, in law or in fact, oral or in writing.
  11. Liability. Subscriber agrees that DOESTraining.com will not be liable for any special, indirect, or consequential damages, including but not limited to the loss of use or the loss of information of any kind, however caused, under any theory of liability, including claims based in contract, tort, negligence, strict liability or otherwise resulting from the use or decision of the content by Subscriber or third party during the Subscription period. Subscriber also agrees that DOESTraining.com will not be liable for any errors, omissions, delays or interruptions in the delivery of the newsletter(s).
  12. Unauthorized Access. Subscriber shall use best efforts to protect against unauthorized access, reproduction, disclosure or use of the newsletter(s). In the event Subscriber becomes aware of any unauthorized use or disclosure of usernames and passwords, Subscriber shall notify DOESTraining.com immediately in writing and shall give full cooperation to minimize the effects of such unauthorized use or disclosure.
  13. Entire Subscriber Agreement. This Subscriber Agreement constitutes the entire agreement between the parties pertaining to the subject matter hereof and supersedes all prior agreements, understandings, negotiations and discussions, whether oral or written, of the parties.
  14. Intellectual Property. This Subscriber Agreement does not grant any rights (including Intellectual Property Rights) to the Subscriber except as expressly permitted in this Subscriber Agreement.
